The Kia Optima is sold as the Kia K5 in South Korea. This Optima was badged as a K5, had South Korean-market Kia badges inside and out, and a window sticker shaped like South Korea. Even though the car isn't old enough to be US-legal...
...I think it's an actual K5. Some cars are allowed to be sold with minor modifications to make it legal. My guess is that the K5 and Optima have the same body structure, meaning the K5 passed safety tests, but needed modifications for emissions.
